IN ACKNOWLEDGEMENT OF CONSIDERATION DULY RECEIVED FROM WETZEL COUNTY ANIMAL SHELTER, INCLUDING BUT NOT LIMITED TO RECEIPT OF THE SUBJECT ANIMAL, I,______________________________, FULLY AGREE TO THE FOLLOWING:

#1.  The Wetzel County Animal Shelter does not make any implied or expressed guarantees with regard to this animal, other than as stated in this contract.  The animal is adopted by the Adopter As Is.  The Adopter hereby assumes all liability for the animal for any injury or damage which may occur.  The Wetzel County Animal Shelter makes no claims or representation as to the temperament or mental disposition of the animal put up for adoption.  Actions of animals are often unpredictable.  It is understood by the Adopter that they accept possession of, title to, and responsibility for the animal adopted and hereby release and discharge the Wetzel County Animal Shelter, The Wetzel County Commission and Wetzel County forever from liability of any injury or damages to any person or property caused in the future by said animal, and from any causes of action, claims, suits or demands whatsoever that may arise as a result of such injury or damages. >                                        _______Initial

#2.  We do our best to ensure that animals adopted from the Shelter are in good health. However, there is always a possibility of an animal becoming ill after the adoption.   If this occurs, we cannot pay veterinary bills associated with the adopted animal.

#3.  If this animal is not already altered….As a condition of my adoption of this animal , I am required to have the animal spayed or neutered within 30 days of adoption.  Penalty under WV law is defined.  I agree to have it spayed/neutered by  _____/_____/_____.  I shall not allow a female to have a litter or a male to breed a female. I understand that my failure to do so will constitute a breach of this adoption contract. ANY WILLFUL VIOLATION OF THIS  PORTION OF THIS AGREEMNENT WILL ALSO RESULT IN A PENALTY OF  $1500.00.   I will mail proof of spay/neutering by this date to the Wetzel County Animal Shelter.  I understand that if I cannot produce proof of spay/neutering by the above date, the animal WILL be reclaimed and legal action may be taken to reclaim the animal.  Wetzel County Animal Shelter reserves the right, at any time, to reclaim this animal in the best interest of it’s welfare if Wetzel County Animal Shelter becomes aware of  neglect, mistreatment, denial of medical care, non-compliance with this contract or non-compliance with local, county, and state laws regarding animal ownership.  In the event that legal action must be taken in order to reclaim this animal any and all legal fees incurred by Wetzel County Animal Shelter in order to do so will be paid for by me, the adopter.>                       _______initial.

#4.  I Agree to provide Adequate food, water, shelter, exercise, veterinary care and to care for the animal in a devoted and humane manner for the duration of it’s natural life.>                                                                                                        _______initial.

THIS MEANS:

  1. This animal will be an indoor animal only.  At no time will the animal live permanently outside.__________initial.
  2. I agree to keep the animal on my property or within my control at ALL times and to keep the animal as a pet and companion, not for any commercial or utilitarian purpose.>                                                                           _______initial.
  3. If the animal is a cat, I agree NOT to keep the animal outside or to allow the animal to roam free. The cat will be an indoor cat only, allowed outside only with direct supervision. I understand that declawing is inhumane and I will not declaw for any reason.>                                                                                                                                    _______initial.
  4. If I no longer desire or am able to keep the animal, I will return it to the shelter.  I also agree to report the loss of death of the animal to the shelter.  Failure to do so may result in legal action.                                                            _______initial.

This agreement shall be governed by and construed in accordance with West Virginia State Law, and all actions shall be filed in the Commonwealth of West Virginia. The Agreement constitutes the sole Agreement between the parties and supersedes any and all prior agreements with respect hereto; and is severable, so that if any portion hereof is deemed invalid, the remainder hereof shall remain in full force and effect.
